Welcome to samsphotographyllc.com (the “Site”), operated by Sam’s Photography LLC (“the Business,” “we,” “our,” or “us”).

These Terms of Service govern access to and use of this website, including its content, photography portfolio, and information about our professional services.

By accessing or using this Site, you acknowledge that you have read and agree to these Terms of Service. If you do not agree, please discontinue use of the Site.

These Terms are separate from any individual photography contract, consultation agreement, licensing agreement, invoice, or other written agreement entered into with Sam’s Photography LLC.

1. PURPOSE OF THE WEBSITE

The Site serves as the official online portfolio and business platform of Sam’s Photography LLC.

It may include examples of photography and video work, service descriptions, business information, pricing information, contact forms, galleries, and other materials relating to our professional services.

Services offered may include, but are not limited to:

Portrait and senior photography.
Family and couples photography.
Commercial and organizational photography.
Tribal, cultural, and community events.
School and sporting events.
Real estate and property photography.
Aerial and drone photography.
Video production and visual storytelling.
Museum, exhibition, publication, and documentary projects.

Information displayed on the Site is provided for general informational purposes and does not constitute a guarantee of availability, pricing, or acceptance of a particular assignment.

2. INTELLECTUAL PROPERTY & COPYRIGHT

All original photographs, videos, graphics, written content, branding, and other creative materials published on this Site are the intellectual property of Sam’s Photography LLC or their respective credited owners.

Unless otherwise established through a separate written agreement, Sam’s Photography LLC retains full copyright ownership of photographs and creative materials produced by the Business.

Access to this Site does not grant visitors ownership, licensing rights, or permission to reproduce its content.

You may not, without prior written authorization:

Download, reproduce, or redistribute photographs for unauthorized use.
Copy, modify, sell, or commercially exploit website content.
Remove watermarks, copyright notices, or identifying information.
Use photographs in advertising, publications, or promotional materials.
Claim authorship or ownership of original creative work.
Use photographs for artificial intelligence training, dataset development, or other machine-learning applications.

Requests for image licensing, commercial usage, reproduction, or publication must be directed to Sam’s Photography LLC.

Artificial Intelligence and Unauthorized Use: All photographs, videos, original content, and other materials created by Sam’s Photography LLC are protected by copyright. No person, organization, company, platform, or third party may use these materials to train, develop, test, or improve artificial intelligence systems, machine learning models, generative AI tools, or datasets without prior written authorization from the Business.

This restriction includes scraping, uploading, extracting, copying, or otherwise supplying images to AI platforms or databases for training, analysis, generation, or other automated purposes. No license or permission to access, view, download, or use an image shall be interpreted as permission for AI-related use.

3. CLIENT PHOTOGRAPHS & IMAGE LICENSING

Clients do not automatically acquire copyright ownership through the purchase of photography services.

Image usage rights are established through the applicable signed contract, licensing agreement, or written authorization.

Depending on the assignment, clients may receive personal, editorial, promotional, or commercial usage rights.

Unless otherwise agreed in writing:

Copyright remains with Sam’s Photography LLC.
Clients may only use images within the scope of their granted license.
Additional commercial usage may require additional licensing fees.
Images may not be resold, sublicensed, or transferred to unauthorized third parties.
Expanded usage rights require written authorization.

The Business reserves the right to establish separate licensing conditions for commercial, institutional, cultural, and organizational assignments.

Restrictions on AI Use and Alteration: A client’s right to use licensed photographs does not include the right to submit, upload, or provide those photographs to generative AI platforms or other AI systems for image generation, manipulation, replacement, reconstruction, or creation of derivative imagery without prior written authorization from Sam’s Photography LLC.

This includes using AI to alter a person's appearance, create synthetic versions of individuals, remove or replace people, generate additional scenes, or otherwise materially change the original photograph. AI-generated alterations must not be presented as authentic photographs created by the Business.

4. CONSULTATIONS & PROFESSIONAL SERVICES

Sam’s Photography LLC provides professional photography services as well as consultation, planning, creative development, and project-related services.

General inquiries concerning basic pricing, availability, and standard portrait services are complimentary.

Professional consultations may be subject to fees when involving larger or more complex projects, including but not limited to:

Museums and cultural institutions.
Tribal governments and organizations.
Educational institutions and school districts.
Businesses and commercial organizations.
Nonprofit organizations.
Exhibitions, publications, and documentary projects.
Custom photography and organizational assignments.

Current consultation rates are:

30-minute consultation: $50.
60-minute consultation: $100.
Additional 30-minute increments: $50.

A complimentary introductory conversation of up to 15 minutes may be offered at the Business’s discretion.

Consultation fees compensate the Business for professional time, expertise, planning, and project discussion. Payment is independent of whether the client ultimately proceeds with a photography booking or project.

Consultations do not automatically include formal proposals, research, production planning, exhibit development, participant coordination, or other separately scoped services.

Additional services require separate estimates or written agreements.

5. PRICING, ESTIMATES & PAYMENTS

All pricing is subject to the scope, duration, complexity, location, intended usage, and requirements of the requested assignment.

Published starting prices and estimates are provided for general informational purposes and may not represent the final cost of a project.

Unless otherwise agreed in writing:

Payments must follow the schedule established in the applicable invoice or agreement.
Consultation fees must be paid before the scheduled consultation.
Final balances must be paid before delivery of final photographs or other deliverables.
Additional work, extended coverage, expanded editing, and licensing may incur additional charges.

Organizations requiring purchase orders, vendor registration, or alternative invoicing arrangements must communicate these requirements before services are scheduled.

Written authorization and approved payment arrangements must be established before additional professional work begins.

Payment obligations for authorized consultations and separately approved professional services remain in effect regardless of whether a subsequent photography project is awarded, funded, approved, or completed.

6. BOOKINGS, CANCELLATIONS & PROJECT CHANGES

Photography bookings are subject to availability and are not confirmed until the applicable agreement and payment requirements have been satisfied.

Estimates, inquiries, and preliminary discussions do not constitute confirmed reservations.

Cancellation, rescheduling, deposits, refunds, and other booking conditions are governed by the applicable service agreement.

Changes to an agreed project scope may require revised estimates, additional fees, or written authorization.

Sam’s Photography LLC reserves the right to decline additional work outside the original agreed-upon scope.

7. CLIENT COMMUNICATIONS & BUSINESS RECORDS

Communications with Sam’s Photography LLC may include email correspondence, website submissions, text messages, social media messages, written proposals, invoices, and other business-related communications.

The Business may retain relevant communications and records for legitimate business purposes, including:

Administrative and operational records.
Project documentation and client correspondence.
Invoicing and payment records.
Contractual obligations.
Dispute resolution and legal compliance.
Business recordkeeping and professional reference.

Records may be retained for applicable legal, accounting, and administrative periods.

Communications will not automatically be treated as public material or authorized for promotional use.

The Business handles personal information in accordance with its Privacy Policy.

8. ELECTRONIC COMMUNICATIONS

By visiting the Site, submitting forms, or communicating electronically with Sam’s Photography LLC, you acknowledge that the Business may communicate with you electronically.

Electronic communications may include estimates, invoices, agreements, disclosures, scheduling information, and other business correspondence.

Where permitted by applicable law, electronic records and signatures may satisfy requirements for written communications and agreements.

You are responsible for providing accurate contact information and maintaining access to your communications.

9. PRIVACY & PERSONAL INFORMATION

Sam’s Photography LLC respects the privacy of website visitors, clients, and individuals represented in its photography.

10. MINORS, IMAGE PERMISSIONS & ARTIFICIAL INTELLIGENCE

A. Photography & Publication Involving Minors

Sam’s Photography LLC maintains a heightened standard of care regarding the photography, publication, distribution, and commercial use of images depicting individuals under the age of 18.

The Business does not publish, publicly display, or use identifiable photographs of minors in its portfolio, website, social media, promotional materials, or other public-facing platforms without appropriate prior written authorization.

Authorization must be established through one of the following:

Written permission from a parent or legal guardian.
Written contractual authorization from an organization, institution, school, tribal government, or other authorized entity, provided that the organization has the appropriate legal authority and all required parent or guardian permissions and individual releases have been obtained.

Verbal permission, informal conversations, or implied consent are not considered sufficient authorization for public publication.

Organizational agreements involving minors must clearly establish the scope of permitted photography, publication, distribution, and intended image usage.

Permission to photograph does not automatically constitute permission to publish, distribute, license, or commercially use an image.

The Business reserves the right to decline publication of an image involving a minor, even when permission has been obtained.

B. Privacy & Protection of Minors

Sam’s Photography LLC recognizes that photographing an individual does not automatically grant unrestricted rights to publish or distribute their likeness.

The Business takes particular care when working with schools, youth organizations, tribal communities, families, and other institutions involving minors.

Images will be handled according to the applicable releases, contractual agreements, privacy requirements, and intended usage permissions.

The Business does not knowingly publish identifying personal information about minors alongside photographs without appropriate authorization.

C. Artificial Intelligence & Synthetic Imagery

Sam’s Photography LLC does not endorse or align with the creation, distribution, or exploitation of artificial intelligence-generated imagery that depicts child sexual abuse, sexual exploitation, or the sexualization of minors.

The Business maintains a firm position against the use of generative artificial intelligence to fabricate, sexualize, manipulate, or exploit the likeness of children.

The Business does not authorize the use of its copyrighted photographs, client galleries, or original visual materials for unauthorized artificial intelligence training, dataset development, synthetic image generation, or other machine-learning applications.

Unless expressly authorized in writing, photographs produced by Sam’s Photography LLC may not be submitted to artificial intelligence systems for the purpose of generating manipulated depictions, synthetic identities, or misleading representations of individuals.

D. Authenticity & Documentary Integrity

Photography is a form of documentation, storytelling, and visual representation.

Sam’s Photography LLC values the authenticity of photographic work and recognizes the responsibility that comes with documenting real people, communities, cultural gatherings, and historical moments.

The Business does not use generative artificial intelligence to fabricate documentary events, create false photographic evidence, or misrepresent individuals, cultural practices, or historical circumstances as authentic photographs.

Any permitted use of artificial intelligence-assisted tools must not mislead clients or audiences regarding the authenticity or origin of photographic material.

E. Ethical Standards & Professional Position

Sam’s Photography LLC recognizes that technological developments do not automatically establish ethical standards or eliminate the responsibility to protect individuals from exploitation.

The Business maintains the position that the ability to generate, possess, or distribute synthetic imagery does not make its creation or use ethically acceptable.

The Business reserves the right to refuse assignments, licensing requests, image manipulation, or other services that conflict with these standards.

These policies apply to the Business’s own work and to permissions granted for the use of its copyrighted materials.

11. CULTURAL REPRESENTATION & IMAGE PERMISSIONS

Sam’s Photography LLC may document cultural gatherings, tribal events, community activities, ceremonies, and other culturally significant subjects.

The Business recognizes that not all cultural imagery is appropriate for unrestricted reproduction, publication, or commercial distribution.

Certain assignments may involve additional permissions, image restrictions, community considerations, review procedures, or licensing requirements.

Access to publicly displayed photographs does not grant permission to reproduce, distribute, or commercially use those images.

Requests involving culturally significant or community-specific imagery should be directed to the Business for review.

12. THIRD-PARTY LINKS & SERVICES

The Site may contain links to external websites, platforms, or services operated by third parties.

These links are provided for convenience and informational purposes.

Sam’s Photography LLC recognizes that Tribal Nations possess inherent sovereignty and may maintain their own laws, courts, regulations, procurement requirements, and dispute-resolution procedures.

For projects involving Tribal Nations, tribal governments, tribal enterprises, or tribal organizations, applicable jurisdiction, governing law, dispute-resolution procedures, and contractual obligations may be established through a separate written agreement.

Nothing in these Terms shall be interpreted as an automatic waiver of tribal sovereign immunity, an assertion of jurisdiction over a Tribal Nation, or a limitation of any rights, protections, or immunities recognized under applicable tribal or federal law.

Unless otherwise established through a separate written agreement, disputes arising from these Terms shall be brought before a court of competent jurisdiction in Wisconsin, subject to applicable jurisdictional requirements and legal limitations.

Nothing in this section prevents either party from pursuing applicable statutory rights or remedies.

19. CHANGES TO THESE TERMS

Sam’s Photography LLC reserves the right to revise, update, or replace these Terms of Service as business operations, services, or applicable legal requirements change.

Updated versions will be published on this Site with a revised effective date.

Continued use of the Site after updated Terms are published constitutes acceptance of the revised Terms to the extent permitted by applicable law.
